Terms of Service

Operator: Time Never Stops, LLC (“Time Never Stops,” “we,” “us,” or “our”)

1. Acceptance of terms

By accessing or using GTX, our mobile application and related online services (together, the “App”), you (“User” or “you”) agree to these Terms of Service (“Terms”). If you do not agree, do not use the App. Our Privacy Policy explains how we collect and use personal information.

2. Description of service

GTX helps LGBTQIA+ people discover places, events, and community connections based on shared interests and location. Features may include personalized recommendations, listings, user profiles, messaging, AI-assisted experiences, and location-based services. We may add, change, or remove features over time.

3. User accounts

  • Registration: You must create an account to use many features. You agree to provide accurate, current information.
  • Account security: You are responsible for safeguarding your credentials and for activity under your account.
  • Age: You must be at least 18 years old to use the App.
  • Suspension or termination: We may suspend or terminate your account if you violate these Terms (including our acceptable use standards in Section 5), create risk or legal exposure, or for other reasons described in these Terms, subject to applicable law.

4. User content

  • Responsibility: You are solely responsible for content you post or share (“User Content”).
  • Prohibited content: You agree not to post content that is illegal, harmful, harassing, infringing, spam, discriminatory, hateful, false, misleading, or otherwise objectionable as we may reasonably determine.
  • License to us: You grant Time Never Stops a non-exclusive, worldwide, royalty-free license to host, use, reproduce, modify (for formatting or display), and display User Content solely to operate, improve, and promote the App.
  • Removal: We may remove or restrict User Content that violates these Terms or that we are required or choose to remove for legal, safety, or operational reasons.

5. Acceptable use and community standards

GTX is built for and by the LGBTQIA+ community and allies who share its values of dignity, safety, and inclusion. You agree to treat others respectfully and to use the App in that spirit.

Without limiting anything else in these Terms, you must not use the App to harass, abuse, threaten, or demean others; to promote violence; or to post hate speech or other content we reasonably determine is bigoted or discriminatory—including toward LGBTQIA+ people or toward any group or individual based on attributes such as race, ethnicity, religion, national origin, disability, gender, sexual orientation, or gender identity. Conduct that members of our community reasonably experience as hostile or intolerant may violate these Terms even if you did not intend it that way.

Enforcement: We take intolerance seriously. We may remove content, suspend or terminate accounts, issue warnings, or take other action at our sole discretion, at any time and with or without prior notice, if we determine that your conduct or content is inconsistent with these standards, harmful to users or our mission, or otherwise inappropriate for GTX—including for reasons beyond those listed here. Nothing in these Terms obligates us to monitor all content or disputes. Where required by law, we will comply with applicable process.

6. Fees, subscriptions, and paid features

We may offer paid subscriptions, upgrades, or other premium features from time to time (“Paid Features”). Your purchase may be processed by third parties such as Apple (App Store) or Google (Google Play). Payments, billing, renewal, cancellation, refunds, and disputes are also governed by those platforms’ terms and policies when they apply.

When Paid Features are available, we will present additional terms or disclosures at purchase (including price, renewal period, and how to cancel). Features, availability, and pricing may change; where required, we will give reasonable notice. To the extent allowed by law and platform rules, Paid Features are offered “as is” alongside the rest of the App.

7. Location and device data

  • Consent: By using location features, you consent to collection and use of location and related signals as described in our Privacy Policy.
  • Accuracy: We do not guarantee the accuracy of maps, places, events, or location-derived results.
  • Your controls: You can manage location, motion, notifications, and other permissions in your device settings.

8. Intellectual property

  • Our property: The App, branding, and our content (excluding your User Content) are owned by Time Never Stops or our licensors and are protected by intellectual property laws.
  • Limited license: We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in line with these Terms.
  • Restrictions: You may not copy, modify, distribute, sell, lease, reverse engineer, or scrape the App or our systems, except where law forbids such a restriction.

9. Third-party services

  • Integrations: The App may rely on third-party services (for example maps, sign-in, analytics, messaging, push notifications, hosting, in-app purchase and subscription billing through Apple or Google, and AI providers) as further described in our Privacy Policy.
  • Their terms: Those services are governed by their own terms and privacy policies.
  • No responsibility: We are not responsible for third-party services or content.

10. Disclaimer of warranties

  • As is: The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law.
  • No guarantee: We do not warrant uninterrupted or error-free operation or that the App will meet your expectations.

11. Limitation of liability

  • To the fullest extent permitted by law, Time Never Stops and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the App or these Terms.
  • Our aggregate liability for claims arising out of or relating to the App or these Terms will not exceed the greater of (a) the amounts you paid us for the App in the twelve (12) months before the claim or (b) one hundred US dollars (US$100), if you have not paid us fees.

12. Indemnification

You agree to indemnify and hold harmless Time Never Stops and its affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the App, or your violation of these Terms or applicable law.

13. Governing law and venue

These Terms and any dispute arising out of or relating to the App or these Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for disputes subject to litigation, except that we may seek injunctive relief in any court of competent jurisdiction.

14. Changes to these terms

We may update these Terms from time to time. We will post the updated Terms here and may notify you through the App when changes are material. Your continued use of the App after the effective date of updated Terms constitutes acceptance of those Terms, to the extent permitted by law.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

17. Entire agreement

These Terms, together with the Privacy Policy and any additional terms we present for specific features, constitute the entire agreement between you and Time Never Stops regarding the App.
